Proposed Dam Affects Daddy's Creek
The Tennessee Division of Water Pollution Control will hold a public
hearing on Thursday, January 11, 2001 at 7:00 P. M. CST in the Fairfield
Glade Recreation Center, located at One Stonehenge Drive at Fairfield
Glade, Tennessee, 38558. Fairfield Glade, Inc. has proposed to construct
a dam on the stream named Cove Branch, a tributary of Daddys Creek in
Cumberland County. The dam would form a lake of about 66 acres at normal
pool. The lake's purpose is to assist in the development of residential
lots. The dam would be about 55 feet high and 850 feet long. Cove
Branch and Daddys Creek are tributaries of the Obed National Wild and
Scenic River.
Persons wishing to comment on or object to the proposal are invited to
deliver oral or written comment at the public hearing. The hearing
officer will limit all testimony to relevant water quality issues and
may limit testimony in the interest of time, however, all persons
desiring to speak will be afforded an opportunity to do so. Written
testimony will be accepted for 10 days following the hearing and will be
considered part of the official record. The public is also invited to
submit comments in writing to the Division of Water Pollution Control at
the address printed below. The comments must be received by January 21,
2001. After considering all public comments, the Division will publish
a final permit decision and a notice of the Division's determinations.

Points that should be made:
- The U.S. Army Corps of Engineers and the Tennessee Department of
Environment and Conservation are under a duty to deny the section 404
and 401 permits required to authorize this project.
- The significant public controversy over this project as well as the
potential impacts to a federal Wild and Scenic river and unit of the
National Park Service warrants the completion of a full Environmental
Impact Statement (EIS) in compliance with the National Environmental
Policy Act.
- The permitting authorities (TDEC and U.S. COE) are under a
responsibility to consider the Outstanding National Resource Water
designation (Tier 3) by the state of Tennessee.
- A comprehensive compensatory mitigation plan must be developed and
evaluated before any further action is taken on this project. The
presence of a wild and scenic river within the watershed, potential
impact of federal species of concern, and designation of portions of the
watershed as an ONRW must be considered in the development of this
mitigation plan.
