HR 2354 (Frelinghuysen) Appropriations for Energy and Water Development:  Makes appropriations for energy and water development and related agencies for the fiscal year ending September 30, 2010. These appropriations include funding for the Army Corps of Engineers, Department of the Interior, Department of Energy, Federal Engergy Regulatory Commission, and others. Passed the House in July 2011, now scheduled for the Senate.
 
Several dangerous bills have sufaced in the US House. These measures include everything from severly limiting EPA's role in water protection as water flows in and out of different states to preventing the addition of species to the list of those threatened or endangered. HR 2018 (Mica) Clean Water Cooperative Federalism Act of 2011: To amend the Federal Water Pollution Control Act to preserve the authority of each State to make determinations relating to the State's water quality standards, and for other purposes.  OPPOSE - this bill is major threat to water quality.  It would:  

  • Restrict EPA’s ability to issue a revised or new water quality standard for a pollutant whenever a state has adopted – and EPA has already approved – a standard, unless the state concurs.
  • Prohibit EPA from superseding a water quality certification (that a discharge will comply with applicable water quality requirements) granted by a state under Clean Water Act ("CWA") section 401.
  • Prohibit EPA from withdrawing approval of a state water quality permitting program under CWA section 402 (regarding the National Pollutant Discharge Elimination System, or "NPDES")), or from limiting federal financial assistance for the state program, on the basis that EPA disagrees with the state regarding a (i) water quality standard that a state has adopted and EPA has approved, or (ii) the implementation of any federal guidance that directs a re-interpretation of the state’s approved water quality standards.
  • Prohibit EPA from objecting to a state’s issuance of an NPDES permit on the basis of (i) EPA’s differing interpretation of an approved state water quality standard, or (ii) the implementation of any federal guidance that directs a re-interpretation of the state’s approved water quality standards.

 
HR 517 (Young):  To amend the Federal Water Pollution Control Act to eliminate the authority of the Administrator of the Environmental Protection Agency to deny or restrict the use of a defined area as a dredged or fill material disposal site, and for other purposes.  OPPOSE
 

S 272 (Manchin):  A bill to amend the Federal Water Pollution Control Act to clarify and confirm the authority of the Environmental Protection Agency to deny or restrict the use of defined areas as disposal sites for the discharge of dredged or fill material.  SUPPORT
 

HR 457 (McKinley)/S 468 (McConnell): To ammend the Federal Water Pollution Control Act to remove the EPA Administrator's authority to disapprove after a permit has been issed by the Secretary of the Army under Section 404 of the Act. OPPOSE
 
HR 872 (Gibbs):  To amend the Federal Insecticide, Fungicide, and Rodenticide Act and the Federal Water Pollution Control Act to clarify Congressional intent regarding the regulation of the use of pesticides in or near navigable waters, and for other purposes.
 
HR 1084 (DeGette)/S 587 (Casey):  Amends the Safe Drinking Water Act to repeal a certain exemption for hydraulic fracturing.  SUPPORT
